Medical Marijuana Cards and Firearm Transfers
Per current Federal Law, marijuana is still an illegal controlled substance. This federal classification applies regardless of individual state laws regarding medical or recreational use.
Per official ATF guidance to Federal Firearms License (FFL) holders, a gun store commits a federal crime if they knowingly transfer any firearm or ammunition to an active user of marijuana. This includes individuals holding a valid state Medical Marijuana Card.
The ATF Form 4473 Perjury Trap
To successfully purchase a firearm from an FFL/Firearms Store, a buyer must complete ATF Form 4473. Question 21 explicitly asks:
“Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?
Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.”
Checking “No” while holding an active medical card constitutes making a false statement on a federal document, which is a felony. Therefore, to legally own, possess, buy, or transfer a firearm or ammunition, you must officially surrender your Medical Marijuana Card BEFORE completing Form 4473 at our store.
How to Surrender Your Florida Medical Card
To surrender your card, you must complete the applicable section on the official form provided by the Florida Department of Health’s Office of Medical Marijuana Use.
- Follow the instructions on the state form.
- Mail the completed form to the state along with your physical card.
Mandatory Store Compliance Policy
If you have already initiated a firearm purchase or background check at our store and have been flagged, delayed, or denied due to medical marijuana card status, we require verified proof of surrender to protect our FFL license and records.
Before we can re-process or clear your transfer, you must provide us with:
- A physical copy of your signed State Card Surrender Form.
- A printout of the US Postal Service tracking number proving the form was successfully delivered to the Florida Department of Health.
Restocking and Return Penalties:
Without this verified paperwork for our permanent store compliance records, the transaction cannot proceed.
- In-Store Purchases: Will be canceled and subjected to a 100% restocking fee.
- Third-Party Online Transfers: The firearm will be returned to the originating dealer at your expense, subject to their specific Return Merchandise Authorization (RMA) approval and fees
